Where the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) apply to Braintric, we manage personal information in accordance with those requirements. This Privacy Policy is intended to be clear, practical and proportionate to the way Braintric operates as an electrical, automation and engineering business.

1. Scope of this Privacy Policy

This Privacy Policy applies to personal information handled by Braintric in connection with our business activities, including enquiries, quotations, project administration, product sales, electrical and automation services, engineering activities, installations, maintenance, technical support, recruitment, supplier relationships and use of our website. It applies to customers, prospective customers, website visitors, representatives of customers and suppliers, contractors, job applicants and other individuals who interact with Braintric.

Depending on the circumstances, Braintric may collect and hold information such as your name, telephone number, email address, residential, postal, billing, delivery or project-site address, company name, job title and other contact details. For project, quotation and service purposes, we may also collect information relevant to the work requested, such as property or site details, photographs, plans, drawings, equipment information, electricity bills, energy-consumption data, technical records, fault information, service history, appointment details, access arrangements, project correspondence and records of instructions. For commercial and administrative purposes, we may hold quotation records, purchase orders, invoices, payment status, transaction references, account correspondence, refund information and records required for taxation, accounting, insurance, legal or regulatory purposes. When you use our website or digital systems, technical information may also be generated, including IP address, browser type, device type, operating system, referring source, pages visited, session information, timestamps and security or diagnostic information.

3. Sensitive information

Braintric does not ordinarily need to collect sensitive information to provide standard electrical, automation or engineering services. If sensitive information is reasonably necessary for a particular activity, we will only collect and handle it where permitted by law and, where required, with your consent. Please do not send health information, government identity documents, passwords, complete payment-card details or other highly sensitive material through ordinary email unless we have specifically asked for the information and provided an appropriate method for supplying it.

This may occur when you contact us, submit an enquiry, request a quotation, place an order, provide project documents, book an appointment, communicate with our staff, make a payment, provide access to a site or otherwise deal with Braintric. Braintric may disclose personal information where reasonably necessary for the purposes described in this Privacy Policy. Where Braintric is likely to disclose personal information to an overseas recipient and the Australian Privacy Principles apply, we will take reasonable steps required by law in relation to that disclosure. Where practicable, we will also identify the relevant countries or regions when our actual provider arrangements make those locations known and reasonably stable. Because cloud and technology providers can change data-processing locations over time, individuals may contact us if they require current information about likely overseas disclosures relevant to their personal information.

Braintric may hold personal information electronically and, where necessary, in physical records. Electronic information may be stored in business email systems, cloud services, accounting platforms, project-management tools, customer records, technical systems, authorised provider platforms and secure devices. We take reasonable administrative, technical and physical steps appropriate to the nature of the information and our operations to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. These measures may include controlled access, authentication, device and network security, software maintenance, backups, staff procedures and confidentiality controls. No internet transmission, electronic system or storage method can be guaranteed to be completely secure. Individuals should avoid transmitting unnecessary sensitive information through insecure channels.

10. Data retention and destruction

Braintric retains personal information only for as long as reasonably necessary for the purpose for which it was collected and for legitimate business, legal, taxation, accounting, insurance, safety, technical, warranty, licensing or dispute-management requirements. Retention periods therefore vary according to the type of record. Project and compliance records may need to be retained for longer periods than general enquiries or routine communications. When personal information is no longer reasonably required and Braintric is not legally required to retain it, we will take reasonable steps to securely destroy it or ensure that it is de-identified.

Where the APPs apply, Braintric will respond to an access request within the period required by law and will provide access unless a lawful exception applies. If access is refused in whole or in part, we will provide reasons and available complaint mechanisms where required.

13. Correction of personal information

You may ask Braintric to correct personal information that you believe is inaccurate, out of date, incomplete, irrelevant or misleading. We will take reasonable steps to assess the request and correct information where required. If we refuse to make a requested correction, we will explain the reason and available complaint mechanisms where required by law.

14. Anonymity and pseudonymity

Where it is lawful and reasonably practicable, you may interact with Braintric anonymously or by using a pseudonym. In many business situations this will not be practicable. For example, we may need to know your identity to prepare a site-specific quotation, arrange access, supply regulated services, deliver goods, enter into a contract, process a payment, maintain project records or comply with legal obligations.

15. Privacy breaches

Braintric takes suspected privacy and data-security incidents seriously. If we become aware of an incident involving personal information, we will assess the circumstances and take reasonable steps to contain, investigate and remediate the issue. Where the Notifiable Data Breaches scheme or another mandatory notification requirement applies, Braintric will assess whether notification is required and will notify affected individuals and the relevant regulator where required by law.

Braintric does not ordinarily rely on automated decision-making systems to make significant decisions about an individual’s rights or interests in the ordinary provision of electrical, automation or engineering services. If our practices change and the Privacy Act requires additional disclosure about the use of personal information in computer-assisted or automated decision-making, this Privacy Policy will be updated accordingly.

17. Privacy complaints

If you believe Braintric has not handled your personal information appropriately, please contact us using the details below and describe the concern in sufficient detail for us to investigate it. We will acknowledge the complaint within a reasonable period, investigate it fairly and provide a response. Where the Privacy Act applies, individuals will generally be expected to give Braintric a reasonable opportunity to respond before escalating the matter externally.
